WEST GOSHEN TOWNSHIP
BOARD OF SUPERVISORS MEETING
JUNE 9, 1999

A regularly scheduled meeting of the Board of Supervisors of West Goshen Township was called to order by Chairman Edward G. Meakim, Jr., at 4:00 p.m. on Wednesday, June 9, 1999, at the Township Building.  All members were present.  Mr. Meakim opened the meeting with the Pledge of Allegiance to the Flag.

Mr. Meakim opened the floor for public comment and there was none.

Ms. Sharon Lynn, Township Manager, announced that the Zoning Hearing Board will hold a public meeting on June 10, 1999, at 7:30 p.m., in the Township Building to hear ZHB 3-99. The applicant, James Miller, is seeking a variance to convert a single family dwelling into an office and to construct a separate building on the property located at the intersection of Old Westtown and Eachus Mill Roads. The Zoning Hearing Board will also hear ZHB 4-99. The applicant, Chester County SPCA, is seeking a special exception to construct an addition.

Ms. Lynn further commented that the Summer Concert Series continues this year and will begin on Sunday, June 13, 1999 at 6:00 p.m., with a children's concert scheduled at the Community Park.

Prior to approval of the minutes for May 26, 1999, the Board wanted to amend these minutes to clarify that the bid opened for video equipment was for the Sewer Department.

On motion by Dr. White, seconded by Mr. Halvorsen, the Board unanimously approved the Board of Supervisors meeting minutes of May 12, 1999 and the amended minutes of May 26, 1999.

On motion by Mr. Halvorsen, seconded by Dr. White, and upon one correction being made, the Board unanimously approved the Treasurer's Reports dated May 31, 1999, for the General Fund, the Sewer Revenue Fund, the Capital Reserve Fund, and the Waste and Recycling Fund, as well as the bills to be paid from the General Fund, the Sewer Fund, the Capital Reserve Fund, and the Waste and Recycling Fund.

Lieutenant Joseph J. Gleason presented the police report for the month of May, 1999.

Evelyn Baker, resident of 900 Sheridan Drive, questioned the number of valid alarms that the police respond to.  David McCoach, resident of 114 Fox Knoll Lane, suggested amortizing the cost of false alarms over the cost of each officer to respond. Ronald Nagle, Esquire, Township Solicitor, responded by acknowledging that there is recent legislation addressing how fines are levied for false alarms. He advised that he and Sharon Lynn will be reviewing this to determine the needs of the Township. Ralph Brown, Fire Marshal, commented that these same issues occur with automatic fire alarms.

Ralph Brown, Fire Marshal, gave the Fire Marshal Report for the month of May, 1999. Mr. Brown also gave the reports for the West Chester Fire Company, Goshen Fire/Ambulance, and Good Fellowship Ambulance Club.

Kenneth E. Lawrence, Jr., Township Engineer, gave the Building Inspection Activity Report for May 1999.

On motion by Mr. Meakim, seconded by Mr. Halvorsen, the Board unanimously approved the appointments of Leslie K. Bair and Robert Cifone to the Park and Recreation Board.

Prior to approval and adoption of Ordinance No. 5-99, Ronald C. Nagle, Esquire, Township Solicitor, explained that the Township amended the existing Cable Communica- tions Regulatory Ordinance to be consistent with the recent Federal Regulations that were enacted in the Tele- communications Act of 1996.  Sharon Lynn, Township Manager, explained the highlights as they pertained to West Goshen Township including the Township's ability to collect 5% of all gross fees charged by cable companies.

On motion by Mr. Halvorsen, seconded by Dr. White, the Board unanimously approved the adoption of Ordinance No. 5-99, the Cable Communications Regulatory Ordi- nance, amending in its entirety the existing Cable Television Franchise Ordinance.

Prior to signing the agreement between the County of Chester and the West Chester Area School District apportioning the Real Estate Appraiser's fees and expenses in proportion to the tax mills imposed by each taxing authority, Ronald C. Nagle, Esquire, Township Solicitor, explained how the Township took the "laboring oar" to initiate the agreement to be fair with others to contribute money for real estate appeals.

On motion by Mr. Halvorsen, seconded by Dr. White, the Board unanimously approved extending the contract with BFI, for residential solid waste and removal, for one (1) year only with Kenneth E. Lawrence, Township Engineer, reviewing the options when the County settles their own agreement before September, 1999.

On motion by Mr. Halvorsen, seconded by Dr. White, it was approved to appoint a committee of three to open bids for the sale of 4.314 acres of land to 900 Lawrence Drive. The committee appointees are Sharon Lynn, Kenneth E. Lawrence, and Corey Kemp.

There being no further business, on motion by Mr. Meakim, seconded by Dr. White, the meeting was adjourned at 5:05 p.m.
