WEST GOSHEN TOWNSHIP
BOARD OF SUPERVISORS MEETING
April 13, 2005

     A regular meeting of the Board of Supervisors of West Goshen Township was called to order by Chairman Edward G. Meakim Jr., at 4:03 p.m. on Wednesday, April 13, 2005, at the West Goshen Township Administration Building. All members were present.  Mr. Meakim opened the meeting with the Pledge of Allegiance to the Flag.

     Mr. Meakim opened the floor for public comment. No comments were made.

     Ms. McIlvaine stated that West Goshen Township is seeking feature stories of local interest for the Township website.  The submissions should be in one of three categories: People, residents who have made a difference or received an award; Businesses, those that are new or those which are longtime establishments; and Military Personnel. She asked that residents contact the Township if they are aware of subjects who fit in these categories.

     On motion by Dr. White, seconded by Ms. McIlvaine, the Board unanimously approved the Board of Supervisors minutes from March 9 and March 23, 2005.

     On motion by Ms. McIlvaine, seconded by Dr. White, the Board unanimously approved the Treasurer's Report dated March 31, 2005 for the General Fund, the Sewer Revenue Fund, the Waste and Recycling Fund, and the Capital Reserve Fund, as well as the bills to be paid from the General Fund, the Sewer Fund, the Capital Reserve Fund, and the Waste and Recycling Fund.

     Lt. Joseph Gleason gave the Police Report for the month of March 2005.  Lt. Gleason announced that the annual Skatearama that was held on Saturday, March 19, 2005 at Ice Line as part of the "Say No To Drugs" program was a success.

     Mrs. Evelyn Baker, 900 Sheridan Drive, asked how many of the alarms in the Police Report were valid and Lt. Gleason responded that there were 31 fines assessed for false alarms, 41 warnings issued for false alarms, 1 false alarm with no permit issued for the alarm, and 7 valid alarms.  Mrs. Baker suggested that the fines should be raised for false alarms and Mr. Meakim answered that the fines were raised for false alarms in June 2004.

     Ms. Andrea Testa, Fire Marshal, gave the Fire Marshal Report for the month of March 2005. Ms. Testa also gave the reports for Goshen Fire Company and Good Fellowship Ambulance. Ms. Testa said that training in the use of fire extinguishers has started in day care centers and businesses.

     Mr. Richard E. Hicks, Building Official, gave the Building Inspection Activity Report for March 2005.

     Prior to the consideration and possible approval of Resolution 11-2005 for a Right of Way Grant with Verizon-Pennsylvania, Inc., Ms. Sharon Lynn, Township Manager, said that the agreement with Verizon would provide the communication cable for the Nextel Tower which is to be built on the Township property. She said that she and Mr. Richard Craig, Township Engineer, had met with a Verizon representative to discuss the agreement.

     On motion by Ms. McIlvaine, seconded by Dr. White, the Board unanimously approved Resolution 11-2005 for a Right of Way Grant with Verizon-Pennsylvania, Inc. providing for the construction of a controlled environmental vault, serving area interface box, electric meter, conduits, manhole and underground communication lines on Township property located at 1025 Paoli Pike.

     Mrs. Baker asked if Verizon would be paying a fee for the right of way. Dr. White said that the cable is necessary for the Nextel Tower to operate and that Nextel will be paying the fee.  Mr. Craig said that Verizon is a public utility who can use the right of way to install the cable. Dr. White said that Verizon is paying the Township a $25,000 fee for the installation of fiber optic cable throughout the Township. Mrs. Baker asked if Verizon would be responsible for restoring the disturbed areas where the cable is being installed and Mr. Craig said that Verizon must restore the areas to the same condition or better than before construction began. He said that the restoration did not start until April 1 because of the inclement weather. Ms. Lynn said that anyone who is unhappy with the way Verizon is restoring the cable line should call the Township.

     On motion by Ms. McIlvaine, seconded by Dr. White, the Board unanimously approved Resolution 12-2005 setting the date of May 25, 2005, for a Conditional Use Hearing for Sprint Spectrum, L.P., for the installation of commercial communications antennas on an existing utility tower located at Grove Road and Grubbs Mill Road.

     Prior to the consideration of Resolution 13-05 Ms. Lynn stated that on February 10, 2005, the Chester County Commissioners signed and agreed to a Mutual Aid Agreement for emergency services and that they are now asking the municipalities to also sign the agreement to share services with other municipalities.  Ms. Lynn said that Ms. Testa had met with other emergency service personnel to set up the program.

     On motion by Dr. White, seconded by Ms. McIlvaine, the Board unanimously approved Resolution 13-2005 adopting a countywide Mutual Aid Agreement with Chester County for Emergency Services.

     Mr. Meakim opened the floor for public comment. No comments were made.

     There being no further business, on motion by Mr. Meakim, seconded by Ms. McIlvaine, the meeting was adjourned at 4:16 p.m.

Supervisor Hearing

S-03-05

     Supervisor Hearing S-03-05,which was duly advertised, was called to order by Chairman Edward G. Meakim at 4:26 p.m.  All members were present.

     Mr. Joseph E. Brion, Esquire, was present to represent the Township.  Mr. Wayne S. Melnick, Esquire, was present to represent the applicant. The hearing was for the consideration of the application of West Chester University of Pennsylvania, who is the owner of a 172.774 acre tract of land which is located on the east side of South New Street behind the Sturzbecker Health Science Center in West Goshen Township. The property is used as the University's athletic fields.  The applicant intends to install new field lighting for use of the multi-purpose athletic fields during evening hours and requires Conditional Use approval from the Board of Supervisors pursuant to Section 84-57.10.7 of the West Goshen Township Zoning Ordinance to do so.  The University is requesting to use the lights beyond 10:00 p.m. until 12:00 a.m. any day of the week.

     The hearing was recessed at 5:56 p.m. and resumed at 6:04 p.m.

     After the presentation of testimony from two witnesses, on motion by Dr. White, seconded by Ms. McIlvaine, the hearing was continued to a date certain of April 27, 2005 at 4:00 p.m.

     The hearing was adjourned at 6:25 p.m.
