Mr. Raymond McKeeman, Zoning Officer, announced that the Zoning Hearing Board of West Goshen Township will conduct a public hearing on Thursday, February 15, 2007, at 7:00 p.m. to consider the following
application:
ZHB 1-07: The applicant is The Benson Companies, LLC, Suite 200, 112 Moores Road, Malvern, PA 19355. The legal owners of the real estate are Clyde and June Broadbelt, 901 North New Street, West Chester, PA. The property for which the application is made is 901 North New Street and is zoned R-3A. The applicant is seeking variance relief regarding restriction of construction and uses on prohibitive steep slopes to allow construction of walls and buildings in man made prohibitive steep slopes. The applicant further seeks a special exception to allow the construction of two driveway stream crossings in the Flood Hazard District.
On motion by Ms. McIlvaine, seconded by Mr. Meakim, the Board unanimously approved the Board of Supervisors minutes from December 13, 2006.
On motion by Mr. Meakim, seconded by Ms. McIlvaine, the Board unanimously approved the Treasurer's Report dated December 31, 2006 for the General Fund, the Sewer Revenue Fund, the Waste and Recycling Fund,
and the Capital Reserve Fund, as well as the bills to be paid from the General Fund, the Sewer Fund, the Capital Reserve Fund, and the Waste and Recycling Fund.
Chief Michael Carroll gave the Police Report for the month of December 2006.
Mrs. Evelyn Baker, 900 Sheridan Drive, asked how many of the alarms in the Police Report were valid alarms and Chief Carroll responded that 15 calls were valid.
Ms. Andrea Testa, Fire Marshal, gave the Fire Marshal Report for the month of December 2006. Ms. Testa also gave the report for Good Fellowship Ambulance, Goshen Fire Company and the West Chester
Fire Department.
Mr. John Beswick, Building Official, gave the Building Inspection Activity Report for December 2006.
On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved the signing of the actual use report of state funds ending December 31, 2006.
On motion by Dr. White, seconded by Ms. McIlvaine, the Board unanimously approved Ordinance 01-2007 amending Chapter 78 of the Code of the Township of West Goshen entitled "Vehicles and Traffic" by
designating and subjecting the roads and intersections described herein to certain of the regulatory controls established and mandated in Chapter 78.
Prior to the consideration of the possible approval of Ordinance 02-2007 amending Chapter 74 of the Code of West Goshen, Titled "Taxation", Ms. Kristin Camp, Township Solicitor, explained that the
Pennsylvania Department of Revenue had sent a notice to the Township recommending the change to the ordinance to allow for the collection of the Realty Transfer Tax by the Department of Revenue if it is not
collected at the time of settlement.
On motion by Ms. McIlvaine, seconded by Mr. Meakim, the Board unanimously approved Ordinance 02-2007 amending Chapter 74 of the Code of West Goshen, Titled, "Taxation", Article III, Titled, "Realty
Transfer Tax", to increase the interest that the Township is authorized to collect if the transfer tax is not paid and in such event, to authorize the Commonwealth of Pennsylvania Department of Revenue to determine,
collect and enforce the tax, interest and penalties on behalf of the Township.
On motion by Dr. White, seconded by Ms. McIlvaine, the Board unanimously approved a Final Subdivision Plan for a lot line change for Howard Business Park Associates, LLC, located at 315 Westtown
Road. Mr. Andrew Eberwein from E. B. Walsh Associates was present to represent the plan.
The consideration of a Final Subdivision Plan for a lot line change for John and Vickie Procacci, located at 202 Sunset Hollow Road was tabled as no one was present to represent the plan.
On motion by Mr. Meakim, seconded by Ms. McIlvaine, the Board unanimously approved a Final Land Development Plan for a 1,785 square foot building addition for Fred Beans Ford of West Chester, located at
1155 West Chester Pike. Mr. Chuck Jackson from Yerkes Associates was present to represent the plan.
On motion by Ms. McIlvaine, seconded by Mr. Meakim, the Board unanimously approved a Maintenance Bond with Surety, Maintenance Security Agreement and Deed of Dedication for the dedication of Perry Drive
and a portion of Goshen Road as a Public Road.
Dr. White opened the floor for public comment. No comments were made.
Dr. White announced that there was an increase of $950,000 in the earned income tax in 2006 but a $58,000 decrease in the transfer tax in 2006.
There being no further business, on motion by Dr. White, seconded by Ms. McIlvaine, the meeting was adjourned at 4:20 p.m.
