A regular meeting of the Board of Supervisors of West Goshen Township was called to order by Chairman Patricia B. McIlvaine at 4:00 p.m. on Wednesday, November 12, 2008 at the West Goshen Township Administration Building.  All members were present.  Mrs. McIlvaine opened the meeting with the Pledge of Allegiance to the Flag.

Mrs. McIlvaine opened the floor for public comment.

Ms. Ann Ruhl, 819 Falcon Lane, commented on the apparent increase in neighborhood vandalism. She recounted the recent vandalism of mailboxes, pumpkins stolen and smashed and a neighbor's car window smashed. She asked that the Township Police Department increase patrols in the area to deter vandalism.

Sgt. Tony Storti responded, stating that the Police Department has increased patrols in the area.

Ms. Christine Swarr, 817 Falcon Lane, reiterated Ms. Ruhl's vandalism complaints.

Detective Sgt. Greg Stone responded that increased patrols and surveillance of the area was ongoing. He also requested neighbors report all acts of vandalism against personal property, as the Police Department cannot react without knowing the problem exists.

Ms. Bobby Kelly, 818 Falcon Lane, also stated her concerns about vandalism. She asked that a future Township newsletter contain articles about reporting vandalism and enforcing the Township's curfew for minors less than eighteen years of age. The Board of Supervisors agreed and those types of articles will appear in the Winter 2009 newsletter.

Mrs. Evelyn Baker, 900 Sheridan Drive, asked what types of charges are brought against those who vandalize neighborhoods. Sgt. Storti answered that charges of trespassing and vandalism are the types of charges most often utilized against perpetrators.

Mrs. Baker then asked about the speed signs on High Street, between the Rt. 202 off ramp and Spruce Avenue. She also inquired about the line striping to be finished by Aqua in the Roslyn neighborhood. Mr. Craig later responded, following his arrival at the meeting, that PennDOT was contacted about the speed signs and the Township was awaiting a response. He stated Aqua was scheduled to complete the line striping within the next two weeks.

Mr. Charles Aldworth, 500 Owen Road, complained about the condition of Goshen Road near High Street. He stated the road has many potholes. Mr. Aldworth was informed that this section of Goshen Road is maintained by the Borough of West Chester and that complaints about its condition should be made to the Borough Manger, Borough Public Works Director and/or Borough Council, as West Goshen Township has no jurisdiction.

Mr. Jeff Dipple, 604 Owen Road, asked if any of the vandals have been apprehended. Sgt. Storti responded that several vandals have been apprehended, but he had no specific information to offer.

Dr. White announced that after requests from several residents, the Township staff and Solicitor would investigate establishing a time limit on parking of trailers, boats on trailers, recreational vehicles, campers, etc., on Township streets. Residents complained that neighbors were parking several recreational vehicles and boats on trailers in their neighborhoods for extended periods, causing sight distance and parking issues. Mr. LaLonde stated that due to drafting, review and advertising timing, a potential new Ordinance would be adopted at the earliest in January 2009.

Mr. McKeeman stated that the West Goshen Township Zoning Hearing Board will hold a public hearing on Thursday, November 13, 2008 at 7:00 p.m. for ZHB 7-08. The applicants and legal owners of the property located at 9 Hyllwynd Drive are Donald and Ellen Molineaux who are proposing to construct an in-ground pool at the rear of the dwelling. As the lot fronts on two streets, the proposed pool would be in the front yard setback and the applicants are appealing the decision of the Township Engineer in denying their request to construct a pool in a front yard setback. In the alternative, the applicant seeks variance relief and any other zoning relief which may be required to allow construction of the pool.

On a motion by Mr. Meakim, seconded by Dr. White, the Board unanimously approved the Board of Supervisors minutes of October 8, 2008 and October 22, 2008.

On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved the Treasurer's Report dated October 31, 2008 for the General Fund, the Sewer Revenue Fund, the Waste and Recycling Fund, and the Capital Reserve Fund, as well as the bills to be paid from the General Fund, the Sewer Fund, the Capital Reserve Fund, and the Waste and Recycling Fund.

Sgt. Tony Storti gave the Police Report for the month of October 2008.

Mr. John Beswick, Building Official, gave the Building Inspection Activity Report for October 2008.

Mr. Beswick also gave the Fire Marshal Report for the month of October 2008.  Mr. Beswick then gave the reports for Good Fellowship Ambulance Company and Goshen Fire Company.

Ms. Camp provided an overview of Ordinance 08-2008, amending the Code of Ordinances of West Goshen Township, Chapter 45, titled "Garbage and Recycling" specifically by amending the definitions of "Clear Materials" in Section 45-2; to add a new definition for "Single Stream Recycling" in Section 45-2; to amend Section 45-7 to require single stream recycling by residential property owners; Section 45-0.F to amend the insurance requirements for licensed haulers and Section 45-12 to provide bulk waste pickup once per week.

On a motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved Ordinance 08-2008.

On a motion by Mr. Meakim, seconded by Mrs. McIlvaine, the Board unanimously approved the fire protection services agreement between West Chester Borough and West Goshen Township for the annual sum of $240,332 commencing on January 1, 2009 and ending on December 31, 2013.

On a motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved the installation and erection of a stop sign on Nottingham Drive at the intersection of Nottingham Drive.

Dr. White presented the preliminary 2009 operating budgets for the Township's General Fund, Sewer Fund, Waste & Recycling Fund, State Highway Fund and Capital Reserve Fund. Dr. White stated that no tax increase is anticipated for the General Fund for 2009.

On a motion by Dr. White, seconded by Mr. Meakim, the Board unanimously adopted the preliminary 2009 budgets for the various funds. Adoption of the final 2009 budgets is set for the Board of Supervisors meeting on Wednesday, December 10, 2008 at 4:00 p.m.

Mrs. McIlvaine opened the floor for public comment.

There being no further business, on motion by Mrs. McIlvaine, seconded by Mr. Meakim, the meeting was adjourned at 4:42 p.m.

Consideration and possible approval of a Conditional Use application for Metro PCS of Pennsylvania, LLC who is seeking conditional use approval pursuant to Sections 84-57.03.B(5) and 84-74 of the West Goshen Township Zoning Ordinance for the co-location of six additional telecommunications antennas on an existing water tank located at 1201 Boot Road located in the R-3 Residential District. Applicant also seeks approval to install radio equipment cabinets on a proposed 10' x 16' concrete pad on the ground at the base of the water tank.

Consideration and possible approval of an Ordinance of the Township of West Goshen amending the Code of Ordinances Chapter 84, Zoning, to delete the definition of "Open Space" and add a new definition for "Common Open Space," "Greenway Lands," "Passive Open Space" and "Gross Development Tract Area" in Section 84-8; adding a new Article IV-B to provide for a new R-3B Flexible Design Conservation District and by specifying the use regulations, area and bulk requirements and design standards for such flexible design conservation district and to rezone parcels 52-02-0114, 52-02-0114.01, 52-02-0114.02, 52-02-0114.04, 52-02-0061.010, 52-03-0075, 52-03-0181, 52-03-0182, 52-03-0183, 52-03-0184, 52-03-0185 and a portion of 52-02-0114.5 from R-3 Residential District to R-3B Flexible Design Conservation District.

Consideration and possible approval of a conditional use application field by Jerrehian –a PA General Partnership, the Estate of M. Joseph Jerrehian and the Jerrehian Brothers. The applicant proposes to subdivide the Property and develop approximately 598 dwelling units pursuant to the Flexible Design Development Option which is proposed as part of a zoning amendment which would rezone the Property to R-3B Flexible Design Conservation District. The property consists of 434 acres located at the northwest corner of the Route 322 Bypass and Phoenixville Pike.
