BOARD OF SUPERVISORS MEETING

A regular meeting of the Board of Supervisors of West Goshen Township was called to order by Chairman Patricia B. McIlvaine at 4:00 p.m. on Wednesday, March 18, 2009 at the West Goshen Township Administration Building. All members were present. Ms. McIlvaine opened the meeting with the Pledge of Allegiance to the Flag.

Ms. McIlvaine opened the floor for public comment.

Mr. Brian Sundermeir, 835 S. High Street, asked if the traffic on S. High Street was being monitored by the police and Ms. McIlvaine replied that the police do monitor the traffic in the area. Mr. Sundemeir said that he has observed the police patrolling in the area but not monitoring the speed of the vehicles. Mr. Casey LaLonde, Township Manager, said that he will refer the matter to the police.

Mrs. Evelyn Baker, 900 Sheridan Drive, asked when the fog lines and yellow lines removed by Aqua PA when they were working in the area will be repainted on Spruce Avenue and Mr. Raymond Halvorsen, Public Works Director, said that he will again contact Aqua PA to get a date when the work will be completed. Mrs. Barker noted that Parkside Avenue has cracking pavement and Mr. Halvorsen said he will forward that information to David Woodward, Streets Superintendent, to be checked out.

Ms. Shirley Colvin, 830 Spruce Avenue, asked that another traffic count be done on Jones Lane now that the speed humps have been installed and Mr. LaLonde said he would ask the police to conduct a count. Ms. Colvin asked if a $5,000 grant for a traffic study in the West Chester University area had been received from Sen. Andrew Dinniman and Dr. White responded that no money had been received.

Mr. Chris Esposito, a resident of West Whiteland Township representing Chester County Co-Ed Softball, introduced himself and Mr. Kevin McDonald, a resident of West Chester Borough representing Chester County Slow Pitch Softball. Mr. Esposito asked that the Board reconsider building a new public works building on the site of Hallowell Field since Hallowell is one of the few lighted fields in the area. He said that lighted fields are needed for adult leagues and that they can't wait for fields to be built in West Whiteland Township. Mr. McDonald said that the leagues would have like to have known about the consideration to close Hallowell before the decision was made so their opinions could have been heard. Mr. Halvorsen stated that West Goshen Parks have been dawn to dusk facilities for two decades and that there are no plans to light any other fields. He said that the new arrangement with the West Chester Area School District replaces one field, Hallowell, with four fields for daytime use. Mr. LaLonde said that the decision to close Hallowell was not taken lightly. He said that currently public works equipment is stored off site at a cost that is more than it would be to store it on site.

Dr. White announced that the Board met in Executive Session on March 12, 2009 to discuss legislative matters.

Mr. LaLonde announced that the 4th Annual Chester Creek Earth Day Cleanup will be held on Saturday, April 18, 2009. Participants will meet behind the McDonalds on Gay Street at 9:00 a.m. He indicated that more information was available on the flyers in the racks at the back of the meeting room.

Mr. Raymond McKeeman, Zoning Officer, announced that the Zoning Hearing Board of West Goshen Township will conduct a public hearing on Tuesday, March 31, 2009 at 7:00 p.m. to hear ZHB 1-09. The applicant and legal owner is West Chester University. The conforming property for which the application is made is located at 2 East Rosedale Avenue and is zoned R-3 Residential Zoning District. The existing building, the E. O. Bull Center, is a legal non conforming building which currently encroaches into the front yard setbacks. The Applicant is seeking variance relief to allow a portion of the proposed expansion outside of the building envelope and relief from the requirement that the building envelope be reduced by an area equal to twice the area of the nonconforming building footprint measured to the outside walls which is outside the building envelope; relief from prohibiting loading areas in a front yard; relief to allow a small portion of the storage dumpster enclosure into the front yard; and relief regarding the parking requirements. Additionally the applicant seeks any additional relief necessary to complete the proposed renovations and expansion.

On motion by Mr. Meakim, seconded by Dr. White, the Board unanimously approved the Board of Supervisors minutes of March 4, 2009.

On motion by Mr. Meakim, seconded by Dr. White, the Board unanimously approved the bills to be paid from the General Fund, the Sewer Fund, the Capital Reserve Fund, and the Waste and Recycling Fund.

Prior to the consideration of the possible approval of Ordinance 02-2009 amending the Code of Ordinances of West Goshen Township, Chapter 45, Ms. Kristen Camp, Township Solicitor stated that the proposed ordinance had been advertised in the Daily Local News and filed with the Chester County Law Library and the Daily Local News.

On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved Ordinance 02-2009 amending the Code of Ordinances of West Goshen Township, Chapter 45 Titled "Garbage and Recycling" to comply with Act 90 of 2002 known as the Waste Transportation Safety Act and to amend Section 45-16 to provide that trash cans provided by the Township to residential property owners must stay at the property and to impose a fee for replacement of lost, stolen or damaged trash cans.

On motion by Ms. McIlvaine, seconded by Mr. Meakim, the Board unanimously approved Resolution 09-2009 empowering designated Township personnel to act on behalf of the Township in its transactions with Kyle's Auto Tags.

Prior to the consideration of Resolutions 10-2009, 11-2009 and 12-2009, Dr. White explained that the members of the Planning Commission, Sewer Authority Board and Zoning Hearing Board have been receiving compensation in the amount of $60.00 for each meeting or hearing. He said that because of the economy that amount was being reduced.

On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved Resolution 10-2009 setting the compensation paid to each member of the Planning Commission at $30.00 for each meeting.

On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved Resolution 11-2009 setting the compensation paid to each member of the Zoning Hearing Board at $40.00 for each hearing.

On motion by Dr. White, seconded by Ms. McIlvaine, the Board unanimously approved Resolution 12-2009 setting the compensation paid to each member of the Sewer Authority Board at $40.00 for each meeting.

On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved Resolution 13-2009 for the erection of 25 m.p.h. speed limit signs on Spring Lane.

On motion by Ms. McIlvaine, seconded by Mr. Meakim, the Board unanimously approved Resolution 14-2009 setting the date of May 6, 2009 for a public hearing for West Chester University who is seeking a Conditional Use for the purpose of the expansion of the existing E. O. Bull Center Building.

Ms. McIlvaine opened the floor for public comment.

Mr. Sundemeir asked if the Board would be taking a position on the West Chester University application that will be heard by the Zoning Hearing Board on March 31, 2009 and Dr. White responded that he has no issues with the application. Mrs. Baker asked that the Planning Commission consider the application from the University because she was concerned about a lack of loading facilities.

Mr. Sundemeir asked if the new trash cans distributed by the Township can be identified and Mr. LaLonde said that each trash can has a serial number and that number has been recorded by the Township as belonging to a specific residence.

Mr. Sundemeir asked if Tigue Road could be opened up and Dr. White responded that the road is owned by West Chester University and is partially located in East Bradford Township. He added that neither the University nor East Bradford Township are in favor of opening the road. He said that any expansion on the south campus will have to address the traffic situation.

There being no further business, on motion by Dr. White, seconded by Mr. Meakim, the meeting was adjourned at 4:41 p.m.
