WEST GOSHEN TOWNSHIP
BOARD OF SUPERVISORS MEETING
June 26, 2002

A regular meeting of the Board of Supervisors of West Goshen Township was called to order by Chairman Dr. Robert S. White at 4:00 p.m. on Wednesday, June 26, 2002, at the West Goshen Township Administration Building. All members were present.  Dr. White opened the meeting with the Pledge of Allegiance to the Flag.

Dr. White opened the floor for public comment. No comments were made.

Ms. Nancy D. Rodgers, Zoning Officer, announced that the West Goshen Township Zoning Hearing Board will hold a public meeting on Wednesday, July 10, 2002 at the West Goshen Township Administration Building at 7:30 p.m. to hear two applications.  ZHB 7-02: The applicant and legal owner is Myrwood B. and Susan K. Sutton, 708 Old Westtown Road, West Chester, PA.  The non-conforming property for which the application is made is located at 708 Old Westtown Road.  The applicant is seeking a Variance, or in the alternative is seeking relief, to exceed the 25% expansion restriction for a non-conforming use and any other relief necessary to construct a 1,800 sq. ft. garage/studio. The existing one-car garage shall be removed.  ZHB 8-02: The applicant and legal owner is West Chester Area School District, 829 Paoli Pike, West Chester, PA.  The conforming property for which the application is made is located at the northeast corner of Paoli Pike and Ellis Lane. The property is currently used as Fugett Middle School and East High School. The applicant seeks a Special Exception to permit expansion and is also seeking a Variance for maximum building height; three stories, not to exceed 30 feet and any other relief necessary to permit the applicant to develop and use the property as depicted on the plan.

On motion by Ms. McIlvaine, seconded by Mr. Meakim, the Board unanimously approved the bills to be paid from the General Fund, the Sewer Fund, the Capital Reserve Fund, and the Waste and Recycling Fund.

The Honorable Juan R. Sanchez, a judge for the Court of Common Pleas of Chester County, provided a brief overview of the Chester County "2002 Meet Your Judges Program" which will be held on October 1, 2002, from 7:00 p.m. to 9:00 p.m. in the Historic Courtroom #1 of the Chester County Courthouse. He invited the public to attend this annual event and interact with the judiciary to learn court proceedings as well as how decisions are made in Criminal, Family, Orphans and Civil Courts.  Judge Sanchez also noted that fliers will be available at the West Goshen Township Building explaining the program.

Bids were opened and read by Mr. Richard J. Craig, Township Engineer, for one 6" Portable Trash Pump.

On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously voted to take the bid under advisement and to consult with Mr. John M. Scott, Manager of the West Goshen Waste Water Treatment Plant concerning its appropriateness.

Dr. White opened the floor for public comment. No comments were made.

There being no further business, on motion by Mr. Meakim, seconded by Dr. White, the meeting was adjourned at 4:05 p.m.

Supervisor Hearing

S-3-02

Supervisor Hearing S-3-02, which was continued from the hearing date of June 12, 2002, was called to order by Chairman Robert S. White at 4:20 p.m. All members were present.

Mr. Joseph Brion, Esquire, was present to represent the Township.  Mr. Gilbert R. Carlson, Esquire, was present to represent the applicant, Educational Properties Group, Inc.  The applicant, who is the equitable owner, is seeking to construct student housing at 220 East Rosedale Avenue, being Tax Parcel 52-5-202, which is located in an I-2 Light Industrial District.  The applicant is seeking the Board of Supervisors' approval to amend Section 84-38 to permit student housing as a permitted use in the I-2 Light Industrial District, and to amend Section 84-44-55-E-(1)-(a), by granting the Board of Supervisors power to grant requests in its discretion to permit 9 ft. x 20 ft. parking spaces in an I-2 Light Industrial District, of the West Goshen Zoning Code of 1990 as amended.

Prior to the start of testimony by the witnesses, Mr. Patrick O'Donnell, Esquire, announced that he was present to represent the Borough of West Chester in the proceedings and he asked that the hearing be postponed in order for West Chester Borough to have time to further study the matter.  Mr. Brion stated that this proceeding was a legislative hearing and that the rule of parties to the proceedings did not apply. Mr. Carlson said he objected to Mr. O'Donnell having standing in the hearing and referred to Mr. Brion's statement that this was a legislative hearing. Mr. Brion made the recommendation to the Board of Supervisors that they continue with the hearing and the Board agreed.

At the conclusion of all testimony, followed by comments and questions from West Goshen residents, Mr. O'Donnell and West Chester Borough residents, the hearing was closed. Dr. White announced that the Board of Supervisors would make a decision regarding this application within 60 days.

The hearing adjourned at 6:25 p.m.
