At 4:20 p.m. the record was reopened for a continuation of Supervisor Hearing S-2-02 from April 10, 2002 for the purpose of entering into the record correspondence and a petition received from residents since the hearing was closed.

Ronald C. Nagle, Esquire, Township Solicitor, was present to represent the Township.  John L. Hall, Esquire, was present to represent the applicant, Domestic Violence Center of Chester County, Inc. The applicant seeks to construct a Women's Temporary Residential Care Center at the northeast corner of Garfield Avenue and Paoli Pike.  The Board of Supervisors will consider a proposal amending Section 84-8 defining "Residential Care Center", and adding a new subsection to 84-21-0 "Institutional Care Center with Multi-Family Dwellings", of the West Goshen Zoning Ordinance of 1990 as amended.  The said property is located in the C-2 Commercial Shopping Center District.

See Court Reporter's Transcript

After the correspondence and petition had been entered into the record, Dr. White stated that this is a situation where the Board of Supervisors has been cognizant of the people, who through no fault of their own are trying to right the wrong that has been done to them.  He added that he felt the property of the homeowners on Garfield Avenue will not be adversely affected by amending the code and, therefore, the Board of Supervisors will be doing no harm.  Ms. McIlvaine agreed with Dr. White's statements.

On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved the adoption of Ordinance 8-2002, amending Section 84-8 defining "Residential Care Center", and adding a new subsection to 84-21-0 "Institutional Care Center with Multi-Family Dwellings" of the West Goshen Zoning Ordinance of 1990 as amended.

The hearing was closed at 4:27 p.m.

Dr. White opened the floor for public comment. No comments were made.

There being no further business, on motion by Dr. White, seconded by Mr. Meakim, the meeting was adjourned at 4:28 p.m.

       Respectfully submitted,

       Sharon Lynn
