WEST GOSHEN TOWNSHIP
BOARD OF SUPERVISORS MEETING
September 8, 2004

A regular meeting of the Board of Supervisors of West Goshen Township was called to order by Chairman Patricia B. McIlvaine at 4:02 p.m. on Wednesday, September 8, 2004, at the West Goshen Township Administration Building. All members were present.  Ms. McIlvaine opened the meeting with the Pledge of Allegiance to the Flag.

Ms. McIlvaine opened the floor for public comment. No comments were made.

Ms. Sharon Lynn, Township Manager, announced that Community Day will be held on Sunday, September 12, 2004 from 12:00 p.m. to 5:00 p.m. at the West Goshen Township Community Park.

Ms. Nancy D. Rodgers, Zoning Officer, announced that the West Goshen Township Zoning Hearing Board will meet on Tuesday, September 14, 2004 at 7:00 p.m. to sign the Order for Steven & Lynn Ayers, 600 Perry Drive.  The Zoning Hearing Board granted the Variance application to permit a shed to remain in the front yard along Goshen Road. This is a corner lot and Mr. Ayers constructed the shed in the front yard.  All sheds must be placed in the rear or side yard. Testimony confirmed that due to the topography of the ground, the existing site for the shed is the only place it could be constructed.  The Board will also consider the request dated August 31, 2004 from Steen Outdoor Advertising, to cancel their scheduled hearing of September 14, 2004 and to set a new date in October 2004 to hear their appeal of the denial of a Building Permit for a freestanding outdoor 60 foot high double-faced advertising sign, or in the alternative to challenge the validity of the West Goshen Township Zoning Ordinance, and to seek variances from Chapter 52 "Sign Ordinance". The applicant does not wish to hold a hearing until after the Board of Supervisors considers the amendments, including billboard sign regulations, to the Sign Ordinance on September 22, 2004.

On motion by Mr. Meakim, seconded by Ms. McIlvaine, the Board unanimously approved the Board of Supervisors minutes from August 11 and August 25, 2004.

On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved the Treasurer's Report dated August 31, 2004 for the General Fund, the Sewer Revenue Fund, the Waste and Recycling Fund, and the Capital Reserve Fund, as well as the bills to be paid from the General Fund, the Sewer Fund, the Capital Reserve Fund, and the Waste and Recycling Fund.

Chief Michael Carroll gave the Police Report for the month of August 2004.  Mrs. Evelyn Baker, 900 Sheridan Drive, asked how many of the 101 alarms in the Police Report were valid and Chief Carroll replied that 4 were valid and that 69 of the false alarms resulted in fines being assessed against the owners of the alarms.

Mr. Ralph Brown, Fire Marshal, gave the Fire Marshal Report for the month of August 2004. Mr. Brown also gave the report for Goshen Fire Company and Good Fellowship Ambulance.

Mr. Richard E. Hicks, Building Official, gave the Building Inspection Activity Report for August 2004.  Mrs. Baker asked how many permits for single family houses were issued and Mr. Hicks replied that no permits for single family houses were issued.  Ms. McIlvaine commented on the new format of the Building Inspection Activity Report and said that it is easy to read.  Mr. Hicks replied that under the Building Codes which were adopted by the Board on May 26, 2004 to conform to the Uniform Construction Code, separation of the categories of permits is required.

On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved Resolution 27-04, authorizing erection of "No Left Turn" signs from 7:00 a.m. to 9:30 a.m. Monday through Friday on westbound Boot Road at Laurel Drive, Delmar Avenue and Arlington Avenue.

Dr. White said that a meeting with residents of the Hamlet Hill and Parkchester Developments was held on August 31, 2004 to discuss the "No Left Turn Between 7:00 a.m. and 9:30 a.m." signs and that the residents of Hamlet Hill stated they wanted to retain the "No Left Turn At All Times" sign for Hamlet Hill Drive from westbound Boot Road.

Mrs. Baker said that in the past PennDOT would not allow signs stating specific time restrictions and asked why this was being approved. Dr. White said that PennDOT had changed its regulations as they pertain to signs with time restrictions.  Ms. Lynn stated that certain criteria must be met in order for PennDOT to allow the signs.  She said that the West Goshen Township Police did a survey of the roads in the area in July and August and found that the cut through traffic on the streets warranted the change.  Mrs. Baker asked if this change would affect the school buses and Ms. Lynn replied that the school district was informed of the change and that no complaints have been received.

Prior to the consideration of Ordinance 20-2004 amending the various provisions of the West Goshen Township pretreatment standards and regulations for industrial wastewater discharges, Mr. Ronald C. Nagle, Township Solicitor stated that notice of the ordinance had been published in the Daily Local News on August 25, 2004 and that the proposed ordinance had been filed with the Chester County Law Library and with the Daily Local News.  Mr. Nagle said that the changes in the ordinance were technical in nature and that they were mandated by the United States Environmental Protection Agency. He said that the Township was notified last year of the necessity to adopt the changes to the ordinance and that he had worked with Mr. Michael Moffa, Environmental Compliance Officer for the West Goshen Township Sewer Treatment Plant, to modify the ordinance.  Ms. Lynn stated that Mr. Moffa was present to answer any of the Board's questions.

On motion by Dr. White, seconded by Mr. Meakim, the Board unanimously approved Ordinance 20-2004 amending various provisions of the West Goshen Township pretreatment standards and regulations for industrial wastewater discharges, adopted on May 13, 1998 by Ordinance 8-1998, codified in Article V of Chapter 66 of the Code of the Township of West Goshen, in order to comply with general pretreatment regulations published in 40 CFR, Part 403 of the Code of Federal Regulations, promulgated by the United States Environmental Protection Agency.

Ms. Victoria Dow from the West Chester Public Library gave a presentation to the Board regarding usage of the Library facilities. She stated that the summer reading program had been successful and that when comparing participation by municipalities, West Goshen Township residents made up the second largest group of participants in the program. She added that when circulation statistics are compared, West Goshen Township is the second largest user among the municipalities that the library serves.  Ms. Dow said that the renovations of the Library which are under way with an expected completion date in nine months, will double the available space. Ms. Dow introduced Howard Sundwall, a West Goshen Township resident, who is on the Board of the Library.  Mr. Sundwall said that the Library is closed until next spring to allow for the expansion of the space.  He stated that the Library hopes to open temporary quarters in a building on Carter Drive and he thanked West Goshen Township personnel for their help in getting into the space.  He said the Library is still raising capital funds for the Library expansion and said that he hoped West Goshen Township would participate by making a contribution.

Ms. McIlvaine opened the floor for public comment. No comments were made.

There being no further business, on motion by Ms. McIlvaine, seconded by Mr. Meakim, the meeting was adjourned at 4:19 p.m.

Supervisor Hearing S-7-04 was called to order by Chairman Patricia B. McIlvaine at 4:29 p.m.  All members were present.

Mr. Joseph A. Bucovetsky and Ms. Sharon E. MacLean from McCormick Taylor presented the Final Draft of the West Goshen Township Comprehensive Plan.

At the conclusion of the presentation on motion by Dr. White, seconded by Ms. McIlvaine, the Board unanimously adopted the West Goshen Township Comprehensive Plan.

On motion by Ms. McIlvaine, seconded by Mr. Meakim, the hearing was closed at 5:15 p.m.
